(“Testlio,” “we,” or “us”) and our Web site at http://testlio.com (the “Site”), as well as all related web sites, networks, embeddable widgets, downloadable software, mobile applications (including tablet applications), and any content, features, products, tools, or services provided by us or available through the Site and on or with which a link to these Terms of Use is displayed (collectively, together with the Site, the “Service”). Notwithstanding the foregoing, the Service does not include any test services provided or made available by or on behalf of Testlio, which will be governed by the Full-Service Test Agreement or a separate agreement between you and Testlio. These Terms of Use are a legally binding contract between you and Testlio governing your use of the Service. The terms “you” and “your” refer to the user using or accessing the Service.
PLEASE READ THE FOLLOWING TERMS OF USE CAREFULLY. BY CLICKING “I ACCEPT,” REGISTERING FOR AN ACCOUNT, DOWNLOADING AND INSTALLING A MOBILE APPLICATION, OR OTHERWISE USING OR ACCESSING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS, INCLUDING THE TESTLIO PRIVACY POLICY (COLLECTIVELY, THESE “TERMS”). These Terms of Use provide that all disputes between you and Testlio will be resolved by BINDING ARBITRATION. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract (except for matters that may be taken to small claims court). Your rights will be determined by a NEUTRAL ARBITRATOR and NOT A JUDGE OR JURY and your claims cannot be brought as a class action. Please review the Arbitration Agreement below for the details regarding your agreement to arbitrate any disputes with Testlio.
